These General Terms and Conditions of Use govern access to and use of the website https://www.hellio.com, the purpose of which is to provide users with tools and services related to energy renovation, particularly in the context of Energy Saving Certificates.

Access to the hellio.com website is free of charge. The costs associated with access (hardware, software, Internet connection) remain the sole responsibility of the user. Any use for commercial purposes is prohibited without Hellio's prior consent.

Any contrary terms and conditions put forward by the internet user or user shall therefore, in the absence of express written acceptance, be unenforceable against Hellio, regardless of when they were brought to its attention. The fact that Hellio does not invoke any provision of these terms and conditions at a given time shall not be interpreted as a waiver of its right to invoke said provision at a later date.

- Verification of eligibility for EEC schemes;
- Referral to partner tradespeople or funding organisations.
Article 7 – Responsibilities
Hellio strives to provide information on the website that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies and deficiencies in updates, whether caused by itself or by third-party partners who provide it with this information.
All information provided on the website is given for information purposes only and is subject to change. Furthermore, the information on the website is not exhaustive. It is provided subject to any changes that may have been made since it was posted online.
Hellio cannot be held liable for any material damage related to the use of the website. Article 14 – Force majeure
Contractual deadlines may be extended for any reason that prevents Hellio from fulfilling its obligations, in particular in the event of force majeure (an external, unforeseeable and unavoidable event over which the seller has no reasonable control). In addition to those usually recognised by French case law, any impediment to manufacturing attributable to supply difficulties, labour and material shortages, strikes or transport disruptions are expressly recognised as cases of force majeure. These events shall constitute force majeure even if they do not have the unpredictable, irresistible and insurmountable characteristics of events deemed to constitute force majeure by law.
Article 15 – Data protection
In accordance with the amended French Data Protection Act of 6 January 1978 and the GDPR (Regulation 2016/679), the personal data collected is necessary for processing requests and does not require the user's specific consent in the context of pre-contractual measures.
This data is kept for 6 years (unless otherwise specified in the Privacy Policy) and is intended for Hellio and its partners for the performance of services and the creation of EEC files.

Article 17 - Applicable law and disputes
These Terms and Conditions are governed by French law.
In the absence of an amicable agreement, the user, as a natural person, has the option of referring the matter free of charge to the consumer ombudsman responsible for Hellio Solutions, namely the Association des Médiateurs Européens (AME CONSO), within one year of the written complaint being sent to the professional. The consumer ombudsman must be referred to either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com; or by post addressed to AME CONSO, 11 Place Dauphine – 75001 PARIS.
Any dispute that cannot be resolved amicably will be submitted to the competent courts.
